Content

You are responsible for the content and consequences of all listings, referrals, messages, emails, files, images, or other materials that you send, transmit through, link to or post on YorZ. You understand and agree that YorZ may refuse, delete, move, or suspend the display of any content for any other reason, including but not limited to violating guidelines or inappropriateness. You understand that YorZ or YorZ members may or may not pre-screen content, but that YorZ or its members have the right (but not the obligation) to pre-screen, refuse, remove or move any content posted or submitted to YorZ or any group on YorZ. You also understand and agree that content posted by you may remain on this website after its expiration date, and you may not be able to alter or remove the content. If you agree to the reposting of content, you understand that once a listing is reposted elsewhere, you and YorZ will not be able to edit, remove or ensure the availability of the repostings. For listings that allow reposting, YorZ may repost the listing, but is not required to do so.

This website contains links to websites operated by other entities. YorZ does not control these other websites and is not responsible for their content. A link to another website does not imply endorsement of or any association with the website or its operators.

Conduct on YorZ

You agree that you will not:

• provide false information about yourself or any entity that you represent
• use the website for chain letters, spam, unwanted solicitations or bulk communications
• send, post, or transmit any content that is unlawful, illegal, harassing, defamatory, pornographic, abusive or threatening
• harass, intimidate, degrade or be hateful towards someone based on their religion, gender, sexual orientation, race, ethnicity, age or disability
• impersonate any other person or entity, including, but not limited to a YorZ employee or a group moderator
• misrepresent your affiliation with any other person or entity
• submit large numbers of listings, referrals or content that disrupts communication on the site
• infringe any copyright, trademark, patent or other rights of another person or entity
• automatically download data from the website via spiders, crawlers, robots or other data mining tools without YorZ's consent or without complying with our robots.txt file
• post a listing instructing users not to refer or apply using YorZ's tools
• engage in pyramid schemes, post deceptive bounties, leave feedback for a different member account you control, or use the Refer Someone feature to refer yourself
• post listings that offer multilevel marketing opportunities or require upfront fees
• post listings where pay is 100% by commission or pay is deferred, with exceptions for jobs that offer an unrecoverable draw
• offer, request or deliver illegal services or bounties

YorZ may end your registration, delete your account history and remove your right to use the website for any reason, including but not limited to violating guidelines, violating Terms of Use, or engaging in shenanigans.

Offering a Bounty

If you post a listing with a bounty, you are entering into a contract. You agree to pay the bounty to YorZ if you hire a candidate that applies or is referred via YorZ according to the conditions described in your listing and bounty conditions you posted. You agree not to post a listing with a bounty that you cannot pay or do not intend to pay. If a YorZ member earns a bounty, the member has the right to refuse or return the bounty. YorZ, Inc. also reserves the right to refuse or return a bounty.

Indicating Hired or Not Hired

If you post a listing, you have discretion in determining the criteria used in hiring candidates. When you post a listing with a bounty, you agree to describe the criteria for paying the bounty within the listing body and bounty conditions sections. You agree to inform YorZ that a candidate was hired if you hire, satisfactorily complete a business arrangement with, transact with or successfully utilize the Candidate that applied or was referred via YorZ for the opportunity in your listing.

Hiring a Candidate for Position or Need not Posted

If you post a listing and receive a referral for a Candidate that you eventually hire for a different need or hire for a different position than the one you posted, you are not required to pay the bounty that you offered. However, YorZ strongly recommends that you pay the bounty that you offered as a sign of good faith to the YorZ community.

Multiple Referrals of One Candidate

If you receive multiple referrals of the same Candidate in response to your listing, you determine which referral was most helpful to you. However, YorZ recommends that you pay the bounty to the first person that referred the Candidate you hire as long as the referral meets the criteria described in the listing and bounty conditions sections.

Referring to Listings with Bounties

If you refer a Candidate in response to a listing with a bounty, there are no assurances that you will receive the bounty. You agree that you are relying upon the listing Poster to pay you the bounty if the Poster hires the candidate you referred. If the listing Poster legitimately pays the bounty to YorZ, YorZ will distribute your share of the bounty as determined by the referral chain that led to that Candidate. YorZ provides mechanisms (such as flagging) intended to encourage Posters to pay bounties they have offered. However, if the listing Poster does not acknowledge the hiring of the candidate you refer or pay the bounty, YorZ is not responsible for the bounty payment or for enforcement of the Poster's obligation to pay the bounty. YorZ may also link to listings with bounties (referral awards) offered on third party sites. If a bounty is offered by a company on a third party site, YorZ is not responsible for collecting and distributing the bounty or enforcing the bounty payment.

Joining a Referral Chain

If you join a referral chain using the "email this listing" or "refer someone" features, you must be signed in so that YorZ's system can add you to the referral chain. If you are not signed in, you will not be eligible to earn a share of any bounty offered. YorZ's referral chain system relies on cookies to track the chain of members that facilitated an application or referral. A cookie based system may not work on all computers and all broswers. Therefore, if, for any reason, you attempted to join a chain and the system does not add you, YorZ is not responsible for giving you credit for joining the chain or for sending you your share of the bounty. Jurisdiction and Choice of Law

You agree that the state and federal courts in California will have exclusive jurisdiction in all disputes relating to the use of this website. These terms and conditions will be governed and construed in accordance with California law.

Indemnification

You agree to indemnify YorZ for any losses it suffers (including damages and attorneys' fees related to third-party claims) as a direct or indirect result of any violation by you of these Terms and Conditions.

LIMITATION OF LIABILITY

Your use of YorZ's website is at your own risk. Under no circumstances will YorZ be liable to you or any third party as a result of your use of the YorZ website.

YorZ may change these terms of use with or without notice. Please review this link regularly to see any changes.
